These Terms of Service govern your use of www.kyvere.com and any purchase you make from it. The site is operated by KYVÉRE. By using the site or placing an order, you agree to these terms.

1. Eligibility

You must be at least the age of majority in the State of California, United States to place an order, or have the consent of a parent or guardian. You agree not to use our products for any unlawful purpose or in breach of any law that applies to you.

2. Products, pricing and availability

We do our best to display product colours, images and descriptions accurately, but we can't guarantee your screen shows colours exactly as they appear in person. Product specifications may change as we improve the product.

All prices are shown in US dollars (USD) and may change without notice. We reserve the right to correct pricing or description errors, and to cancel any order placed at an incorrect price — if we do, you'll be refunded in full.

We may limit quantities, restrict sales by region, and discontinue any product at any time.

3. Orders

Your order is an offer to buy. We may accept or decline it. We may refuse or cancel an order that appears fraudulent, is placed by a reseller, contains an obvious error, or that we cannot fulfil. If we cancel, we'll notify you at the email address you provided and refund any payment taken.

You agree to provide accurate, complete and current billing and shipping information.

4. Payment

Payment is taken at checkout via Shopify Payments and the wallets shown at checkout. By submitting payment details you confirm you are authorised to use the payment method. Taxes are applied as required by law and shown at checkout where applicable.

5. Shipping, returns and refunds

Delivery is governed by our Shipping Policy. Returns, refunds and the 60-night guarantee are governed by our Refund & Return Policy. Both are incorporated into these terms.

6. Safe use of our products

KYVÉRE products are cosmetic grooming devices. They are not medical devices and are not intended to diagnose, treat, cure or prevent any condition.

Follow the instructions supplied with the product. Do not use it on broken, irritated, inflamed or infected skin, on open wounds, on moles or warts, or over the same area for a prolonged period. If you have diabetes, neuropathy, reduced sensation, poor circulation, or any foot or skin condition, consult a healthcare professional before use. Stop immediately and seek advice if you experience pain, bleeding or irritation.

Keep out of reach of children. Any results described on this site are illustrative and will vary from person to person.

7. Intellectual property

All content on this site — including the KYVÉRE name and logo, text, images, video, graphics and page design — is owned by us or our licensors and protected by intellectual property law. You may not copy, reproduce, republish or use it commercially without our written permission.

8. Your submissions

If you send us reviews, photos, videos, ideas or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display it in connection with our business, including in marketing. You confirm the content is yours to share and doesn't infringe anyone's rights. We may remove any submission at our discretion and are under no obligation to keep submissions confidential.

9. Accuracy of information

Information on this site is provided for general purposes and may not always be complete or current. Any reliance you place on it is at your own risk. We may change site content at any time without notice.

10. Prohibited uses

You may not use the site to break any law, infringe intellectual property, transmit malware, harvest data, interfere with the site's security features, or attempt unauthorised access to our systems.

11. Third-party links

Our site may link to third-party sites and services we don't control. We're not responsible for their content, policies or practices.

12. Disclaimer and limitation of liability

To the fullest extent permitted by law, the site and our products are provided "as is" and "as available" without warranties of any kind beyond those expressly stated in our Refund & Return Policy and any statutory warranties that cannot be excluded.

To the fullest extent permitted by law, our total liability for any claim relating to a product or your use of this site is limited to the amount you paid for the order in question. We are not liable for indirect, incidental or consequential losses.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or anything else that cannot be limited by law.

13. Indemnity

You agree to indemnify and hold harmless KYVÉRE and its officers, employees and suppliers from any claim arising out of your breach of these terms or your violation of any law or third-party right.

14. Termination

We may suspend or terminate your access to the site at any time if you breach these terms. Obligations incurred before termination survive it.

15. Governing law

These terms are governed by the laws of the State of California, United States, and any dispute will be handled in the courts of the State of California, United States.

We may update these terms at any time by posting a revised version here. Your continued use of the site after changes are posted means you accept them.
